(NEWSCHANNEL 3) - A West Michigan man convicted in a $7 million fraud case may soon walk free.
An appeals court has thrown out charges against Michael Heshelman.
Heshelman is serving a 17-year prison sentence right now.
He was convicted in 2010 on fraud charges.
Federal prosecutors say he lived lavishly off money he collected from unwitting investors.
The case is being thrown out because the court says prosecutors waited too long to take the case to trial.
Heshelman was indicted in 2006, but wasn't arrested until 3 years later.
