BATTLE CREEK, Mich. (NEWSCHANNEL 3) - A Calhoun County man is charged with killing a 4-year-old boy, five years after the case against him was dismissed.
30-year-old Adam Markos is accused of killing his ex-girlfriend's son, Dominic Munoz in 2007.
He was arrested Tuesday and re-issued the charge of open murder and first-degree child abuse.
Newschannel 3 has been following this story since Markos was first arrested in August 2007.
Calhoun County Prosecutor David Gilbert immediately re-opened this cold case when he took office.
He says he can't see why the trial was dropped a day before it was supposed to start. With this second chance, we learned the prosecution found new evidence.
"You have a new prosecutor here who is going what he is going I'm not pleased with his decision," said Tom Schaeffer, Defense Attorney.
Investigators found four-year-old Dominic Munoz dead in Markos' Bedford Township home August 6, 2007. The boys mother testified how unusual Markos reacted when she came home to find her son lifeless while in his care that night.
"He kept saying 'what do you want me to do?' and he just didn't move," said Lynn Wozinak, Victim's mother. She also described having to leave her child's body to call 911 herself.
An autopsy showed the boy died from blows to the head. Doctors also testified they found bruises on his back and in his mouth, as well as an earlier injury that started to heal.
Dominic's family created a YouTube video called "Justice For Dominic Munoz" in 2010 asking the public to help them urge the county prosecutor at the time to re-open the case and find justice.
Markos was given no bond Wednesday. If found guilty he could face life in prison.
