PORTLAND, Maine (NEWSCHANNEL 3) – There is an unusual story out of Maine Tuesday morning.

A man there is known for his whistling around town, but now a judge says he needs to keep moving.

Robert Smith has been cited several times for disorderly conduct for his "loud whistling" in Portland.

He says he's just trying to make people happy, but several businesses say it is so loud it's driving customers away.

A judge has now ordered Smith can keep whistling, but he has to walk while he does it. That way it shouldn't bother people in any particular area.
