COLORADO (NEWSCHANNEL 3) - In Colorado, prosecutors have decided to seek the death penalty for the man charged in the Aurora movie theater shooting, James Holmes.
Holmes is accused of killing 12 people and injuring 70 more in that rampage last July.
His lawyers had offered a guilty plea as long as the death penalty was taken off the table, but prosecutors refused the deal.
Holmes did not react when he heard the news, but others in the courtroom were thankful for the decision.
Holmes was originally scheduled to go to trial in August, but that has now been pushed back to February.
He faces 166 felony counts for the shooting massacre.
