BATTLE CREEK, Mich. (NEWSCHANNEL 3) - A new lawsuit is taking aim at the Battle Creek Police Department.
It comes off the heels of a shooting last November.
Police were called to the Drive-Thru Party Factory in Battle Creek on reports of a teen carrying a gun.
Police did not know the gun was fake and an officer shot 14-year-old Nicholas King in the shoulder.
The shooting was found to be justified, but now a lawsuit claims police violated the rights of three minors who were witnesses to that shooting.
They claim after that, they were unlawfully detained, ordered into cop cars and held at the police station for more than two hours, even though they had done nothing criminal.
The lawsuit calls the officers' actions toward the teens -quote "outrageous, reckless and grossly negligent."
